5 Things to Know When Responding to Divorce Papers

Hossein Berenji, May 09, 2025

If you have been handed divorce papers, you are likely experiencing a range of emotions. Even if you were expecting these documents, nothing can prepare you for the actual moment you receive them. How you respond can set the tone for your divorce proceedings in Los Angeles, CA, and ultimately determine the outcome you receive. Below are five things to be aware of after you have been served with divorce papers.

Determine Your Course of Action in Response to Divorce Papers

When you have been served with divorce papers, you may initially be unsure of your response. While this is normal, you do still need to act quickly. Begin by conducting a thorough reading of the divorce papers to see what is being requested.

Determine what aspects of their request you agree with and which ones you do not. If you want to make a counter-request, be sure to make notes of what you object to and what you would like to negotiate during the divorce. You can also make a list of your own requests.

Respond to Divorce Papers in a Timely Manner

In the state of California, you have 30 days to file your response to divorce papers. If you fail to respond, a default judgment may be entered in favor of the partner who filed for divorce. By submitting a response, you have the opportunity to make requests and negotiate the outcome of your divorce. In the event you were unaware that you were being served with divorce papers and did not respond, you may be able to contest a default divorce.

File the Correct Paperwork

When responding to divorce papers, you must file the correct paperwork so your response is legally recognized. The first form you must fill out is FL-120 Response – Marriage/Domestic Partnership. This document provides details about your relationship and divorce request. If you have children under 18, you must also fill out form FL-105 Declaration under the Uniform Child Custody Jurisdiction and Enforcement Act.

Understand Your Methods of Response

You have a few different options for filing a response to the divorce papers you received. The most effective way to file your response is to take your response forms and two copies to the clerk at your local courthouse. If this is not feasible, you may file the same documents by mail or online if your court allows it. You must also pay a filing fee ranging from $435 to $450, or request a fee waiver if you cannot afford it.

Serve Your Spouse With Your Official Response

Once you have filed your response with the court, the final step is to serve your spouse with your official response. This ensures that the response process is complete and official. Your response must be filed by someone other than yourself.

This party must be over the age of 18 and uninvolved in your divorce. They must mail your response and any additional documents that were filed. The server must complete the Proof of Service by Mail form detailing the service.

Enlist the Help of an Experienced Divorce Attorney

With several specific steps and very little time to respond, it is crucial to enlist the help of a skilled divorce lawyer immediately. They can help you take stock and identify what you want in the divorce, ensuring that all steps are followed correctly to protect your interests. Lawyers understand that it can be difficult to accept that your marriage is over, and they can answer all your questions and provide valuable support during this major change in your life.
